Your Rights as a Citizen and the Duties of the Nigerian Police.


The police force is a critical institution in the organization of any society where law and order is expected to prevail unrestrained. The police everywhere in the world provides services that directly impact on human lives. In Nigeria,the police force has encountered a number of challenges some of which relate to recruitment, training, inefficiency, corruption and indiscipline.
Facts About Bail 
Bail is the release of an accused person who has been in a lawful custody. The 1999 constitution of the Federal Republic of Nigeria as amended stipulates that any person who is detained by the police for the purposes of bringing him before a court in execution of a court order or upon reasonable suspicion of his having committed a criminal offence other than an offence punishable with death, or to prevent him from committing a criminal offence, shall be brought before such court of law within:
1. A period of one day where the court having jurisdiction over his case is within forty two kilometres; and
2. A period of two days where the court is within a distance beyond forty kilometres.
If he is not brought to a court of competent jurisdiction within this period, section 35 (4) of the constitution provides that he should be released either unconditionally or upon such conditions as are reasonably necessary to ensure that he appears for trial at a later date.
However, it is necessary to state that these conditions do not apply strictly to an accused person who is suspected to have committed an offence punishable with death. This constitutional provision can be found in other laws likes the Criminal Procedure Act in sections 17, 18 and 19 which provides as follows: When any person has been taken into custody without a warrant for an offence other than an offence punishable by death any officer in charge of the police station, may, in any case, and shall, if it will not be practicable to bring such person before a magistrate or justice of peace having jurisdiction with respect to the offence charged within twenty four hours after he was so taken into custody, inquire into the case and unless the offence appears to such officer to be of serious nature may discharge the person upon his entering of recognizance with or without sureties for a reasonable amount to appear before a court at the time and place named in the recognizance.
A Recognizance is a promise or undertaking made by an accused person to appear in the court of law or police station or any other place as he may be required by his undertaking. The law stipulates that on entering into such recognizance, even without a surety, the accused person is to be granted bail. It is not mandatory under the law that he should produce a surety once his identity, address of place of abode and work are disclosed and they are confirmed to be true.
Please note: Bail is not to be at any cost! It is to be granted FREE of charge. It is pertinent to note that the clause which says “upon entering into recognizance for a reasonable amount” does not contemplate that any deposit of money should be made to the police for bail. The amount so entered in the recognizance is a guarantee recoverable by the court from the accused or his surety, on default by the accused person.
Note however, that an individual who is arrested by the police is only but a suspect and is presumed innocent until the contrary is proven. Nigerians are hereby advised that it is unnecessary to shiver or beg law enforcement agents with money and other valuables to gain freedom in the event of an arrest. You are entitled to bail where the offence so committed is not punishable by death.
We have erroneously made our lives so vulnerable to all sorts such that police men capitalise on our ignorance to unleash terror on us. The state powers which they exercise are meant to protect the citizens not the other way round and you pay tax in return for this.
My advice is that once a policeman or any other law enforcement agent harasses you or coerces anyone in your presence take down his or her name. Their names are tagged on their uniforms. Write a petition against him or involve the law to enforce your fundamental rights.
See another citizen intimidated, Capture the scene with a video recorder, attach the video footage to a petition and proceed. Go on the social media networks, upload the video footage and watch it go viral. That way, you will have made indelible expression that will incriminate such officers and they will be made to face the wrath of the law.

Major Key to Freedom

   Talented Individuals can make a city, a state, a country and the world a better place. Nigeria is the bedrock of Africa and I must say the most talented country in Africa.  

   How many talented graduates are out there? how many job opportunities are there for them?
   Most Nigerians have the Capability to start a small scale business today, that will eventually become a big scale tomorrow, but the cost of powering a small scale firm that need stable electricity is totally high in Nigeria than it's in developed country's. why?
   America is a perfect description of a citizen base economy "I hope you understand what I mean"
   America is great today because the citizens invest in their country to make it a perfect place.

Why are they motivated to invest in their country? 

  There are many  utility company's in the United States, which brings competition and When there is competition what happens?

In America today there are over 40 (forty) Electricity Companies  

  1. When there is competition, Everybody buckle up to be at Their best. 
  2. When there is competition there is Equilibrium in demand and supply 

 Now in America there is stable electricity at affordable subscription, you can produce at the comfort of your home and advertise your products. When everybody is producing and there are many products in the market, the price system automatically stabilizes. 

   How many Billionaires do we have in Nigeria today? And how many are willing to invest in their country. Many graduates would rather start up a private small scale business they will struggle to make great, than working for another individual. 

When the economy is circulating, rate of crime decreases, rate of fake products decreases and other agendas solve itself gradually.


Nigeria can still be a better place..

Fear

Why!!!!! Why do they say that what ever goes up must come down??? I don't think that would be an awesome experience after reaching the top then suddenly you go down. Take Nigeria for example, whatever goes up remains up, indirectly defying natural law, though sometimes they try to twist the situation around.
This country is in a spell that rips the tail, we pledge allegiance to a flag since elementary, ruled always by the same peeps, and in our suffering they excel.

The law is not applicable to them, since I was a teen have always heard about OBJ and today I still hear about him. I really see him like a horse in a mountain, standing on its two feet after a victory, won't be so bad to be like him.
Imagine if I owned a farm like his after becoming a celebrity won't that be awesome??? and for the fact that I want to be sooooo rich and famous, makes me feel and strongly say that coming down after you are already up naa rubbish!!!


These thoughts were battling inside my head before I got a slap on my feet, waking me from sleep  by mum just to tell me my phone was ringing mtcheew... gave a long sigh wish I could just go back to sleep, but I prefer setting up a chimney inside my head and starring at the passers-by through the balcony  though my mind would be far away in another world where everything is possible.‎ All you need to do is focus closely even while you are on the ground, but should I just continue sleeping when after evaluating everything around me, I can see that I don't need the president or the country to save me, I just need myself to save me.‎

Welcome Back!!!

This is definitely my first post after a very long time. Actually this post is not my first but actually the     very first in 2017.
Just a short introduction...I am smart, a song writer, blogger
Like always, I enjoy sharing my thoughts on my note pad and then to the studio..creating a beat and voicing and all the stuffs that goes with making a song, but today I want to share a work of mine, guess is a nice head start for the year. Happy New Year Readers

Diamond Rolex on my wrist
But I still need more time
Many drives in the world 
But we still need more gas

Fresh day, fresh worries
Making plans you gat to hustle
Why do plans always crumble
Everyday we gatz reshuffle 

I look straight to the sky
Try to get some real attention
